• App: The Smpl mobile application.

5. Opening an Account

To use our Services, you must open an account with us. You must be at least 18 years old, or the age of majority in your state or country of residence, to open an account and use the Services. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary.

 

6. Your Smpl Account

6.1 Account Details. Your account allows you to hold, send, and receive electronic money and payments. The electronic money held in your account does not expire, except when your account is closed. The electronic money will not earn interest.

6.2 One Account per Person. You may only open one account unless we have agreed in writing to additional accounts. We may close or merge duplicate accounts.

6.3 Verification. We may require you to provide additional information to verify your identity. Failure to provide requested information may result in suspension or termination of your account.

 

7. Use of Services

7.1 Permitted Use. You agree to use our Services only for lawful purposes. You must not use our Services for any illegal activities, including but not limited to money laundering, fraud, or funding terrorism.

7.2 Restrictions. You must not:

• Use our Services in any way that breaches any applicable local, national, or international law or regulation.

• Use our Services for any fraudulent or malicious activity.

8.2 Currency Conversion. If your transaction involves a currency conversion, we will use the exchange rate at the time of the transaction. We do not guarantee that you will receive any specific exchange rate.

To the extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or use, arising out of or in any way connected with the use of our Services.

27. Entire Agreement

This Agreement constitutes the entire agreement between you and Smpl Life Inc. regarding the use of our Services and supersedes all prior agreements and understandings.

 

28. Waiver

Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.

 

29. Force Majeure

We shall not be liable for any failure to perform our obligations under this Agreement where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation.
